What 1910.212 requires
One of the most cited standards in general industry
1910.212 is short, two paragraphs of substance, and it sits near the top of
general industry citations year after year. That combination is the
problem. Employers read a brief standard, assume compliance is simple, and
get cited on equipment that has been running the same way for a decade.
The core requirement in (a)(1) is that one or more methods of guarding
protect the operator and other employees from hazards including point of
operation, ingoing nip points, rotating parts, and flying chips and sparks.
Note that it says other employees, not just the operator. A guard that
protects the person running the machine while leaving the aisle side open
does not satisfy the standard.
(a)(3)(ii) requires point of operation guarding on any machine whose
operation exposes an employee to injury, and the guard must prevent the
operator from having any part of the body in the danger zone during the
operating cycle.
(b) requires machines designed for a fixed location to be anchored to
prevent walking or moving.
What I actually find
Guarding findings come from two places, and neither is complicated:
- The equipment never had the right guard from the manufacturer
- Someone removed it, because it was cumbersome to work around, or
maintenance took it off and never put it back
The three machines I find unguarded most often are drill presses, table
saws, and bench grinders. None of them are exotic. They are the equipment
that has been in the corner of the shop long enough that nobody looks at it
anymore.
Who it applies to, and common exemptions
There is no grandfather clause
This is the misreading that costs employers the most, and I hear it on
nearly every walkthrough. The machine did not come with a guard from the
manufacturer, or it predates the standard, so surely it is exempt.
It is not. 1910.212 places the duty on the employer, not the manufacturer.
The obligation is to guard the hazard, and it does not matter whether the
machine shipped guarded, when it was built, or how long it has run that
way. If the equipment creates a point of operation, nip point, or rotating
part hazard today, it requires guarding today.
There is no age exemption, no size threshold, and no grandfather provision
anywhere in the standard. A machine bought in 1974 with no guard from the
factory needs a guard now, and the employer buys it.
The scope is broader than people assume
1910.212 is the general requirement, and its breadth is what catches
employers out. If a machine creates a hazard and no more specific standard
covers it, 1910.212 applies.
Specific standards take precedence where they exist. Mechanical power
presses fall under 1910.217, woodworking machinery under 1910.213, abrasive
wheels under 1910.215, mills and calenders under 1910.216. In practice most
employers do not know those standards exist, which is its own problem: a
table saw is woodworking machinery and a bench grinder is an abrasive
wheel, so two of the three machines I find unguarded most often are
governed by a standard the employer has never read.
When no specific standard covers the machine, 1910.212 is the catch-all,
and the catch-all is where most general industry equipment lands.
What the standard does not excuse
Compliance is judged on the guard in place at the time of inspection, not
on what the machine shipped with or what the program says. A guard sitting
on a shelf is not a guard.
If the machine has to run with the guard off for setup or maintenance, that
is a lockout question under 1910.147, not a machine guarding exemption.
What a compliant written program must contain

Affix guards to the machine where possible; if attachment to the machine is not possible, secure the guard elsewhere. Ensure the guard itself does not present an accident hazard.

Recognize and treat the point of operation as the area on a machine where work is actually performed upon the material being processed; machines whose operation exposes an employee to injury must have the point of operation guarded. The guarding device must either: (1) be in conformity with any appropriate standards therefor, or (2) if no applicable specific standards exist, be designed and constructed so as to prevent the operator from having any part of his body in the danger zone during the operating cycle.

If using special handtools for placing and removing material, ensure each tool: permits easy handling of material without the operator placing a hand in the danger zone; is not used in lieu of other guarding required by this section; and is used only to supplement the protection provided by required guards.

Recognize that the following machines are some of the machines which usually require point of operation guarding; the listed machines are: (a) Guillotine cutters; (b) Shears; (c) Alligator shears; (d) Power presses; (e) Milling machines; (f) Power saws; (g) Jointers; (h) Portable power tools; (i) Forming rolls and calenders. A program should treat these machine types as typically needing point of operation guarding.
1910.212(a)(3)(iv)
Guard revolving drums, barrels, and containers by an enclosure that is interlocked with the drive mechanism so that the barrel, drum, or container cannot revolve unless the guard enclosure is in place.

When the periphery of the blades of a fan is less than seven (7) feet above the floor or working level, the blades must be guarded, and the guard must have openings no larger than one-half (1/2) inch.

§ 1910.212 General requirements for all machines. (a) Machine guarding —(1) Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are—barrier guards, two-hand tripping devices, electronic safety devices, etc.
(2) General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.
(iii) Special handtools for placing and removing material shall be such as to permit easy handling of material without the operator placing a hand in the danger zone. Such tools shall not be in lieu of other guarding required by this section, but can only be used to supplement protection provided.
(iv) The following are some of the machines which usually require point of operation guarding: ( a ) Guillotine cutters. ( b ) Shears. ( c ) Alligator shears. ( d ) Power presses. ( e ) Milling machines. ( f ) Power saws. ( g ) Jointers. ( h ) Portable power tools. ( i ) Forming rolls and calenders.
(4) Barrels, containers, and drums. Revolving drums, barrels, and containers shall be guarded by an enclosure which is interlocked with the drive mechanism, so that the barrel, drum, or container cannot revolve unless the guard enclosure is in place.
(5) Exposure of blades. When the periphery of the blades of a fan is less than seven (7) feet above the floor or working level, the blades shall be guarded. The guard shall have openings no larger than one-half ( 1/2 ) inch.
(b) Anchoring fixed machinery. Machines designed for a fixed location shall be securely anchored to prevent walking or moving.
